Can I be dismissed for joining a union?
No. Interfering with, restraining, or coercing workers in their right to self-organisation is an unfair labor practice under Article 259 of the Labor Code. Dismissal for union membership or activity is illegal, and a worker dismissed on that basis may seek reinstatement with back wages. If it happens, document everything and speak to us immediately β timing matters in these cases.
What is security of tenure?
A regular employee may only be dismissed for a just or authorised cause under Articles 297 and 298, and only after due process β which means two written notices and a real opportunity to be heard. A dismissal that skips the procedure is defective even when the underlying reason was valid.
What deductions can my employer make from my wages?
Article 113 permits deductions only in narrow circumstances, including where the worker has given written authorisation. This is why the CFW loan facility requires a signed payroll deduction authority from each member before anything is released β without it, the deduction itself would be unlawful.
Am I entitled to 13th month pay?
Rank-and-file employees who have worked at least one month in a calendar year are entitled to 13th month pay under Presidential Decree 851, payable on or before 24 December. It is a legal entitlement, not a bonus at the employer's discretion.
How is overtime and holiday pay calculated?
Work beyond eight hours carries an additional 25% of the hourly rate on ordinary days. Rest day and special day work carries a 30% premium; regular holidays are paid at 200% for the first eight hours. Many CBAs improve on these floors β that is one of the things bargaining is for.
What if my employer does not remit my SSS or Pag-IBIG?
Deducting contributions from wages and failing to remit them is a criminal offence, not merely a labour violation. Keep your payslips. You can verify your posted contributions directly with SSS and Pag-IBIG, and any gap between what was deducted and what was posted is evidence.
How many workers do we need to form a union?
For an independent union, at least 20% of the bargaining unit must be members for registration. Affiliating with a registered federation such as CFW is often the faster route β the federation already holds the legal personality, and a chapter can be chartered without a separate registration.
What does CFW charge?
Membership dues are set by the chapter and remitted through standard check-off. There is no joining fee, and no charge for grievance representation or legal referral. If anyone asks you for money to process a membership, that is not us.
